Title: ‘Deepfakes & Digital Replica Laws: A Transatlantic Perspective’

Abstract

Recent A.I. technology allows deepfakes – realistic digital replicas – to be generated without a person’s consent. While some jurisdictions recognise rights of image, publicity or personality, England & Wales does not. The current patchwork of applicable laws in this jurisdiction thus contains gaps and limitations regarding this issue. In comparison, this seminar evaluates recent U.S. legislation addressing non-consensual digital replicas. These legal protections, in particular at state level, have arisen in response to calls for reform. The seminar examines whether limitations faced in the U.K. are similarly present in the U.S. legislation, with a special focus on post-mortem protection. Also explored are broader questions such as how digital replica rights may interact with other relevant laws. Such comparative analyses could be helpful in multiple jurisdictions grappling with these timely issues.
